By using NanoPix, you agree to these Terms of Service. Please read them carefully.
1. Service Description
NanoPix is an AI-powered photo editing application that uses artificial intelligence to enhance and modify your photos based on text prompts. All edited images are generated by AI and should not be represented as original photographs.
2. AI-Generated Content & Transparency (EU AI Act)
In compliance with Article 50(4) of the EU Artificial Intelligence Act (Regulation 2024/1689), all edits produced by NanoPix are AI-generated or AI-manipulated content. You acknowledge that:
- Results are produced by third-party AI models (currently Black Forest Labs FLUX Kontext Pro, FAL.ai, and Google Gemini) and may vary in quality
- AI-generated images are artificially generated or manipulated and depict fashion items, styling, or effects not present in the original photo
- AI-generated images must not be misrepresented as original, unedited photographs
- When sharing AI-edited images, you should disclose that they have been AI-modified
- We may change AI providers at any time to improve service quality
- Some AI providers (BFL, FAL.ai) may use your inputs (photos and prompts) and generated outputs to improve their models. Google does not use API inputs or outputs for model training
- AI-generated images may contain machine-readable metadata or watermarks; you agree not to remove or alter such markings
3. Your Photos & Consent
By uploading a photo to NanoPix, you confirm that:
- You own the photo or have explicit permission from the person depicted to edit it
- You will not upload photos of individuals without their knowledge and consent
- You understand the photo will be sent to third-party AI services for processing
- You accept that some AI providers may use inputs and outputs to train and improve their models (Google does not)
4. Account & Credits
- Free users receive 3 credits upon registration
- Pro subscribers receive 100 credits per month
- Credits reset monthly for subscribers
- Unused credits do not roll over
- Each AI edit consumes 1 credit
5. Subscriptions & Payments
- Subscriptions are managed through Apple App Store or Google Play
- Prices are displayed in your local currency
- Subscriptions auto-renew unless cancelled 24 hours before the end of the current period
- You can manage subscriptions in your device settings
6. Acceptable Use
You agree NOT to use NanoPix to:
- Generate illegal, harmful, offensive, or sexually explicit content
- Create non-consensual intimate imagery or deepfakes intended to deceive, defame, or harass
- Edit photos of other people without their knowledge and explicit consent
- Misrepresent AI-generated images as original photographs for fraudulent purposes
- Use AI-generated content to impersonate another person
- Violate intellectual property rights
- Attempt to reverse-engineer or exploit the service
- Remove or alter machine-readable markings or metadata from AI-generated images
7. Content Ownership
You retain ownership of photos you upload. You own the AI-generated outputs and may use them for personal or commercial purposes. However, you acknowledge that the underlying AI models, algorithms, and technology remain the property of their respective providers (Black Forest Labs, FAL.ai, Google).
8. Limitation of Liability
NanoPix is provided "as is" without warranties. We are not liable for any damages arising from your use of the service, including AI-generated results that may not meet your expectations.
9. Refund Policy
Refunds are handled by Apple App Store or Google Play according to their respective policies. Contact the store where you made your purchase for refund requests.
10. Termination
We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from the Profile menu.
11. Changes to Terms
We may update these terms. Continued use after changes constitutes acceptance of new terms.
12. Governing Law
These terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy.
